Q. What federal labor law posters do I need to post?

A. If you’re a business with at least one employee, you’re required to display certain federal labor law posters in a common area of your workplace where all employees and job applicants can easily view them. Most of these postings are issued by various sub-agencies of the Department of Labor (DOL), except for one, which is issued by the Equal Employment Opportunity Commission (EEOC).

The mandatory federal postings are: Fair Labor Standards Act (FLSA) Poster, Family and Medical Leave Act (FMLA) Poster, Occupational Safety and Health Administration (OSHA) Poster, Employee Polygraph Protection Act (EPPA) Poster, Uniformed Services Employment and Reemployment Right Act (USERRA) Notice and the Know Your Rights: Workplace Discrimination is Illegal Poster by the EEOC (issued on 10/20/22 to replace previous ‘EEO is the Law’ poster).  

Q. What state labor law posters do I need to post?

A. State labor law posters vary by state. No two states have the same requirements, as each state operates its own government agencies and passes its own laws. This is the same situation in counties and cities, as it pertains to local postings. In many cases, these state and local laws provide more generous employee benefits, such as higher minimum wages, more types of paid leave and broader anti-discrimination laws covering different legally protected characteristics (such as sexual orientation).

Q. Is it OK to update posters just once a year?

A. No. Mandatory poster updates can occur anytime throughout the year. While some states implement minimum wage changes in January, that only affects one of several required posters. If you only update posters annually, you will likely fall out of compliance at some point during the year.
