Q. What applicant area labor law posters do I need to display?

A. Employers must display certain employment postings in locations where job applicants can easily view them. By law, this include four of the six mandatory federal postings: EEOC, USERRA (while not specifically mandated, this poster is recommended because the law applies to applicants), EPPA and FMLA (if you have more than 50 employees).

In addition, more and more laws are being passed on the state and local level requiring businesses to display postings to applicants.  Half the states require job applicant posters, as do several cities.

Q. Are applicant area labor posters necessary if we’re already complying with general workplace postings?

A. Yes. This is a compliance requirement many businesses aren’t even aware of, but it must be upheld. If you have applicants coming into your facility for any reason — whether to fill out an application or participate in an interview — you should display the necessary posters on the wall, just as with the regular employee-facing posters.

Q) How do I handle labor low postings for online job applicants?

Employers are required to make the applicant-facing postings available to all applicants, including those who apply online.  This can be managed differently than with applicant area labor law posters, since candidates are completing applications online vs. in person. In this case, electronic posters that are viewable via a web link can be added to your website or online applicant system. This will ensure federal posting compliance, as well keep you up to date with state and local posting requirements for job applicants.
