FAQs About Electronic Posters

Q. Posters take up too much room on our walls. Can we use electronic labor law posters instead?

A. Generally speaking, no. Electronic delivery is not a substitute for full-sized physical posters displayed at your facilities in conspicuous locations accessible to all onsite employees. The federal exceptions are FMLA and USERRA postings, but only if you communicate other policies electronically and provide digital access to all employees. Exceptions also apply for non-traditional worksites without walls (such as mall kiosks and mobile work units), as well as remote/offsite workers.

Q. Is there an easy way to send electronic labor law posters to remote workers?

A. Yes. An electronic poster service can meet your posting needs for remote/offsite workers. Q. Do we have any posting obligations for job applicants?

A. Yes. Employers are required to display certain employment postings in a location where job applicants can view them (for example, in the lobby if that is where applications are typically completed). These requirements apply to online job applicants, as well. Q. We are an employer in a state that must use E-Verify to electronically confirm an employee’s eligibility to work in the United States. Are there notification requirements for this?
